Terms of Service

These Terms of Service ("Terms") are a contract between you and Delroo Inc. ("Delroo", "we", "us") and govern your use of the Delroo food-delivery marketplace at delroo.com and our mobile apps (collectively, the "Service"). By creating an account or placing an order, you agree to these Terms.

1. The Service

Delroo is a marketplace that connects you with local restaurants and independent delivery drivers. We do not prepare food and we are not the employer of the drivers; we provide the platform that coordinates ordering, payment, and dispatch.

2. Eligibility and account

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use Delroo.
• You are responsible for the accuracy of your account information and for keeping your password secure.
• You are responsible for activity that happens on your account. Tell us immediately at support@delroo.com if you suspect unauthorized access.

3. Orders and payment

• Order totals include item prices, applicable taxes, delivery fees, platform fees, and any tip you choose to add.
• Payment is processed at order placement through our payment partner (Stripe). Authorizations may briefly hold funds before final settlement.
• Item availability and prices are set by the restaurant and may change between orders. The price shown at checkout is what you'll be charged.
• You may cancel an order before the restaurant accepts it. After acceptance, cancellation is at the restaurant's discretion.

4. Delivery

• Delivery times are estimates. Traffic, weather, and restaurant prep time can affect them.
• Provide accurate delivery addresses and instructions. Delroo is not responsible for orders delivered to a wrong address you supplied.
• The driver will follow standard handoff procedures (contactless or otherwise) according to your stated preference. If you're unavailable at handoff after reasonable attempts, the order may be returned and you may forfeit the order.

5. Refunds and adjustments

If a meaningful problem arises — missing items, wrong order, food unsafe to eat — contact support@delroo.com within 24 hours. We'll investigate and apply refunds, credits, or replacements as appropriate. Refund decisions are at our reasonable discretion and not guaranteed for every complaint.

6. User conduct

When using Delroo you agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Impersonate someone else, misrepresent your identity, or use someone else's payment method without authorization.
• Harass, threaten, or abuse restaurant staff, drivers, or other users.
• Reverse-engineer, scrape, or interfere with the Service or its underlying infrastructure.
• Place orders you don't intend to receive, or otherwise abuse the marketplace.

Violations may result in account suspension or termination.

7. Intellectual property

Delroo and its licensors own the Service, including our logos, name, software, and the look and feel of the marketplace. You may use the Service only as expressly permitted. You retain ownership of content you submit (reviews, photos), and grant us a worldwide, royalty-free license to use it for operating and promoting the Service.

8. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties (express, implied, statutory) including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

The restaurants on the marketplace are independent businesses. Food quality, accuracy, allergen handling, and food-safety practices are their responsibility. If you have severe allergies, contact the restaurant directly to confirm preparation.

9. Limitation of liability

To the maximum extent permitted by law, Delroo's total liability for any claim arising from or related to the Service is limited to the greater of (a) the amounts you paid us in the six months before the claim, or (b) one hundred US dollars. Delroo is not liable for indirect, incidental, special, consequential, or punitive damages.

10. Termination

You may close your account at any time from your profile settings or by emailing support@delroo.com. We may suspend or terminate your access for violations of these Terms, suspected fraud, or as required by law.

11. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Forsyth County, North Carolina, unless your local law requires otherwise.

12. Changes

We may update these Terms as the Service evolves. The current version is always at this URL with the "Last updated" date above. If a change is material we'll notify you by email or in-app.
